A letter to Canada’s Chief Electoral Officer from 352 scientists
Hundreds of Canadian scientists sent a letter this morning (August 22, 2019) to Stéphane Perrault, the Chief Electoral Officer, urging Elections Canada to clarify how the science on climate change can be communicated during the election period.
The 352 Canadian scientists who signed the letter take issue with Elections Canada’s interpretation of the Elections Act that paid advertising that communicates facts about climate change would require organizations and individuals to register as a third party. Here’s their letter, which was also copied to eight Members of Parliament and the leader of the Bloc Quebecois:
Dear Stéphane Perrault,
Re: Communication of the scientific facts of climate change during elections
We as Canadian and Canada-based scientists and researchers would like to express our profound concern about the way that Elections Canada interprets the Elections Act for the communication of the science of climate change. According to your statement, newsmedia, and other informed sources, climate change may be interpreted as an “issue” during election periods. Charitable or non-profit organizations would need to register as third partiesif they wish to discuss climate change through paid advertising. The bureaucratic process of registering in order to share non-partisan science may stifle evidence-based discussion on climate change during both a crucial democratic process and a critical period for climate action. Together, these items set a chilling precedent for the discussion of science-based concerns. We are very alarmed by this situation.
Clarification of rules does not address the presentation of climate change as debatable
While you have clarified the Elections Canada rules, application of the rules in this case is still problematic. In your clarification, you highlight that the Elections Act does not “make a distinction between facts and opinion”. However, identifying climate change as an issue which could require registration under certain conditions does take a position on climate change. It presents climate change as something about which there is doubt. As this West Coast Environmental Law postdiscusses, Elections Canada does not enforce rules around registration on many other issues upon which there is scientific consensus (e.g. health impacts of tobacco). The scientific consensus on climate change is as absolute as it is for these other “issues”.
The scientific consensus on the existence of human-induced climate change is overwhelming
The global scientific community, as well as Canadianand other national governments, recognize that climate changeis driven by human activity. This is primarily due to greenhouse gas emissions from burning fossil fuels. It is an unprecedented challengeto humanity’s future. The existence of climate change and that it is caused by people isnot a matter of scientific debate.
Further, major legal rulings in Canada have affirmed the unambiguous reality of climate change. In 2019, the Ontario Court of Appealsfound that “There is no dispute that global climate change is taking place and that human activities are the primary cause.” Again in 2019, the Court of Appeal for Saskatchewanfound “The factual record presented to the Court confirms that climate change caused by anthropogenic greenhouse gas [GHG] emissions is one of the great existential issues of our time. The pressing importance of limiting such emissions is accepted by all of the participants in these proceedings.”
The weight of scientific evidence and consistent cross-party political support for major international climate efforts makes absolutely clear that the existence of climate change is not up for debate.
Climate change is impacting Canadians
Climate change impacts are being felt worldwide. Warming in the Canadian North is around twice the global average. This rapid change is thawing permafrost and changing ice cover and seasonal patterns, disrupting communities and livelihoods. More extreme natural hazards such as life-threatening wildfires, floods, and droughts – consistent with scientific projections of climate impacts – are now a regular occurence. As one of the world’s largest per capita emitters of greenhouse gases, Canadians have an important role to play in addressing the causes and effects of climate change both at home and around the world.
Canadians deserve to know
The Canadian electorate deserve every opportunity to learn about climate change. It is already affecting lives and livelihoods. A recent Mainstreet pollrevealed that over 75% of Canadians recognize the overwhelming scientific consensus that human activities are causing climate change – and they want action. The charity and non-profit sector is a key translator of scientific knowledge and pathways to action, helping the public to ask informed questions of their candidates and parties.
We, the undersigned Canadian scientists and researchers, ask that Elections Canada recognize – along with the overwhelming majority of other countriesand global institutions– that human-caused climate change is a non-partisan phenomenon of deep relevance to voters in Canada. We appreciate the importance of the rules in the Elections Act but disagree with the way they are being interpreted in this instance. We ask Elections Canada to clarify their interpretation of issue-based advertising so that organizations and individuals in Canada can engage directly with Canadians on the existence of climate change without third party registration.
